Acceptance of these terms

By using HomeCat, you're agreeing to the terms on this page. If you don't agree with something here, please don't use the Service.

These Terms of Use (the “Terms”) govern your access to and use of the HomeCat website and any related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms.

What HomeCat is

HomeCat helps homeowners with property survey retrieval, simple permit-compliant site plans, and more complex residential drawing requests. Survey retrieval is $99, simple site plans start at $199, and complex drawings are quoted after review.

We are not your municipality, surveyor, engineer, planner, lawyer, or building official.

The Service provides paid document retrieval, site plan drafting, and related residential drawing coordination based on information provided by you and publicly available records. The Service does not constitute legal, planning, engineering, architectural, surveying, or other professional advice, and is not an official source of municipal information.

The drawing is a submission, not a guarantee

We produce a drawing based on the information you give us and publicly available records. We can't guarantee that your municipality will accept it.

Your municipal permit office and the bylaws they enforce are the only authoritative source for what you can and cannot do on your property. You must confirm the details that matter to your project directly with them before you act.

Drawings produced through the Service are for general permit submission purposes and are not a substitute for confirmation by the applicable municipality. Acceptance of any drawing is at the sole discretion of the applicable municipal authority. You must independently verify the applicable permit requirements with the relevant municipality before relying on any drawing.

Accuracy of the drawing

We do our best to produce accurate drawings from the information available to us. We will not always succeed.

Property records have gaps, parcel boundaries can be approximate, and the information you provide us may be wrong. You are responsible for reviewing the drawing before you submit it to your municipality.

The Service is provided on an “as is” and “as available” basis. Despite reasonable efforts to maintain accuracy, HomeCat makes no representation or warranty, express or implied, regarding the accuracy, completeness, currency, reliability, or fitness for any particular purpose of any drawing or information produced through the Service.

You are responsible for what you submit

If you take a drawing from HomeCat and put it into a permit application, a contract, a construction plan, or any other real-world decision, you are responsible for making sure it's correct.

If a submission is rejected, fined, delayed, or has to be redone because the information was wrong or outdated, that consequence — including any financial cost — is yours, not ours.

You are solely responsible for verifying the correctness of any drawing or information you obtain from the Service against the requirements of the applicable municipality before using it in any permit application, submission, agreement, plan, or other action.

To the maximum extent permitted by law, HomeCat, its operators, employees, and contractors will not be financially or otherwise liable for any direct, indirect, incidental, consequential, special, or punitive damages — including but not limited to permit rejection, fines, penalties, application fees, re-submission costs, construction delays, redesign or rework expenses, lost time, lost profits, or disputes with any municipality, contractor, or third party — arising from or related to your use of, or reliance on, the Service.

Permitted use

We provide site plans for projects on properties you own or have a legitimate interest in. Please don't order a site plan for a property you have no relationship to.

Subject to these Terms, HomeCat grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service in connection with permit applications for real property in which you have a legitimate interest.

What you can't do with the Service

Please don't scrape the site, copy our content wholesale, or try to rebuild a competing product from our work.

Don't try to break, overload, or reverse-engineer the Service, and don't use it for anything illegal.

You may not: (a) copy, reproduce, distribute, publicly display, or create derivative works from the Service or its content except as expressly permitted; (b) reverse engineer, decompile, or attempt to extract the source code of the Service; (c) use any automated means to access the Service in a manner that imposes an unreasonable load on our infrastructure; (d) use the Service in violation of any applicable law or regulation; or (e) use the Service in connection with property for which you have no legitimate interest.

Information you give us

To produce your site plan we collect the information you submit through our contact form and any follow-up communication. See our Privacy Policy for details.

We collect and process information you provide through the Service, including addresses, contact information, and project details, in accordance with our Privacy Policy, which is incorporated into these Terms by reference.

Intellectual property

Drawings we produce for you are yours to use for your permit application. The HomeCat website, design, code, and original writing belong to us.

Upon full payment, you receive a non-exclusive licence to use drawings produced by the Service for the permit application and construction project for which they were commissioned. All rights, title, and interest in and to the Service, including its software, user interface, design, text, graphics, and original written content, are and will remain the exclusive property of HomeCat and its licensors.

Service availability

We might change how the Service works, take it down for maintenance, or stop offering it entirely. We'll try not to surprise you, but we don't promise the Service will always be available.

HomeCat may, at any time and without prior notice, modify, suspend, or discontinue all or any part of the Service. We will not be liable to you or to any third party for any modification, suspension, or discontinuation of the Service.

Changes to these terms

We may update these Terms from time to time. If we make a meaningful change, we'll update the date at the bottom of this page. If you keep using HomeCat after a change, that means you accept the updated Terms.

We reserve the right to amend these Terms at our discretion. The “Last updated” date below indicates when the Terms were most recently revised. Your continued use of the Service following the posting of revised Terms constitutes acceptance of those Terms.

Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of laws principles. The parties consent to the exclusive jurisdiction of the courts located in Ontario for the resolution of any dispute arising out of or relating to these Terms or the Service.
