Acceptance of these terms
By using HomeCat, you're agreeing to the terms on this page. If you don't agree with something here, please don't use the Service.
These Terms of Use (the “Terms”) govern your access to and use of the HomeCat website and any related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms.
What HomeCat is
HomeCat helps you explore, create, customize, save, and purchase residential designs and related building plans. The Service may include generated concepts, 3D editing tools, drawings, material estimates, project intake, and optional help from third-party professionals.
We are not your municipality, surveyor, engineer, planner, lawyer, or building official.
The Service provides software tools, generated content, building plans, estimates, and related project services based on information provided by you, automated systems, and third-party or publicly available data. Unless HomeCat expressly agrees otherwise in writing, the Service does not constitute legal, planning, engineering, architectural, surveying, or other professional advice and is not an official source of municipal information.
Accounts
Some features require an account. You are responsible for giving us accurate information and keeping your sign-in details secure.
Anything done through your account is your responsibility. Please contact us promptly if you believe someone else has accessed it.
You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account. You agree to provide accurate, current information and to notify HomeCat promptly of suspected unauthorized access. HomeCat may suspend or terminate an account that violates these Terms, creates risk for the Service or other users, or is used unlawfully.
Purchases
Prices and what is included are shown before you buy. Payments are processed by Stripe, and any taxes or additional options are shown at checkout.
A purchase gives you access only to the product and features described at checkout. It does not include permit approval, construction, or professional certification unless we expressly say so in writing.
Paid products are offered at the price, in the currency, and with the scope displayed at the time of purchase. Payments are processed by Stripe and may also be subject to Stripe's terms. Except where required by law or expressly stated at checkout, a purchase does not include municipal fees, permit approval, construction services, site verification, or review or certification by a licensed professional.
Plans and generated results are not a guarantee
HomeCat can generate designs, plans, estimates, and other project information from the details available to it. Generated results may contain mistakes or assumptions and may not fit your property or local rules.
Your municipality and the professionals working on your project are the authoritative sources for what can be approved and safely built. You must confirm the details that matter before relying on a HomeCat result.
Designs, models, drawings, calculations, estimates, recommendations, and other outputs may be produced or assisted by automated systems and may be incomplete, inaccurate, or unsuitable for a particular site or purpose. Outputs are not a substitute for site verification, professional judgment, or confirmation by the applicable authority. Acceptance of any submission is at the sole discretion of the relevant municipality or other reviewing body.
Accuracy of information and results
We do our best to produce useful results from the information available to us, but we will not always succeed.
Property records can be incomplete, parcel boundaries can be approximate, prices can change, and information supplied by you or third parties can be wrong. You are responsible for checking every result before using it.
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, HomeCat disclaims all warranties, express or implied, including warranties of accuracy, completeness, currency, reliability, merchantability, fitness for a particular purpose, and non-infringement.
You are responsible for what you submit
If you use a HomeCat design, drawing, estimate, model, or recommendation in a permit application, contract, construction project, purchase, or other real-world decision, you are responsible for making sure it's correct and appropriate.
You are also responsible for the accuracy of the measurements, addresses, descriptions, files, and other information you give us.
You are solely responsible for verifying all outputs against actual site conditions, product specifications, applicable codes, permit requirements, and professional advice before using them. To the maximum extent permitted by law, HomeCat and its operators, employees, and contractors will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for permit rejection, fines, application fees, construction delays, redesign, rework, property damage, lost profits, or disputes with a municipality, contractor, or other third party arising from your use of or reliance on the Service.
Permitted use
You may use HomeCat for your own lawful home-planning, design, permit, and construction projects, including projects for a property you own or have a legitimate right to work on.
Subject to these Terms, HomeCat grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for lawful personal or internal business purposes and in connection with real property in which you have a legitimate interest.
What you can't do with the Service
Please don't scrape the site, copy our content wholesale, or try to rebuild a competing product from our work.
Don't try to break, overload, or reverse-engineer the Service, and don't use it for anything illegal.
You may not: (a) copy, reproduce, distribute, publicly display, or create derivative works from the Service or its content except as expressly permitted; (b) reverse engineer, decompile, or attempt to extract source code, models, or underlying data from the Service; (c) scrape, harvest, or use automated means to access the Service without our written permission; (d) bypass access controls, interfere with the Service, or impose an unreasonable load on our infrastructure; (e) upload unlawful, harmful, infringing, or malicious content; (f) misrepresent generated results as professionally certified when they are not; or (g) use the Service in violation of law or in connection with property for which you have no legitimate interest.
Information you give us
You keep ownership of the information and files you submit. You give us permission to use them as needed to operate HomeCat, save your work, generate results, complete your requests, and provide support. See our Privacy Policy for details.
You represent that you have all rights necessary to submit your content to the Service. You grant HomeCat a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, modify, process, and display that content solely as necessary to operate, secure, improve, and provide the Service and fulfill your requests. Our handling of personal information is described in our Privacy Policy.
Intellectual property
You may use the designs and drawings delivered to you for your project. HomeCat's software, product design, brand, catalog, templates, and original site content remain ours or our licensors'.
Subject to these Terms and payment of any applicable fees, HomeCat grants you a non-exclusive, perpetual licence to use outputs delivered to you for your personal or internal project purposes, including related permit applications and construction. This licence does not transfer ownership of the Service, its software, models, interfaces, catalog content, templates, trademarks, or other underlying HomeCat or third-party materials.
Service availability
We might change how the Service works, take it down for maintenance, or stop offering it entirely. We'll try not to surprise you, but we don't promise the Service will always be available.
HomeCat may, at any time and without prior notice, modify, suspend, or discontinue all or any part of the Service. We will not be liable to you or to any third party for any modification, suspension, or discontinuation of the Service.
Changes to these terms
We may update these Terms from time to time. If we make a meaningful change, we'll update the date at the bottom of this page. If you keep using HomeCat after a change, that means you accept the updated Terms.
We reserve the right to amend these Terms at our discretion. The “Last updated” date below indicates when the Terms were most recently revised. Your continued use of the Service following the posting of revised Terms constitutes acceptance of those Terms.
Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of laws principles. The parties consent to the exclusive jurisdiction of the courts located in Ontario for the resolution of any dispute arising out of or relating to these Terms or the Service.
